Collin Kaepernick, former San Francisco 49ers quarterback, filed a grievance against the NFL and its owners, alleging they colluded to keep him out of the league after taking a knee during the National Anthem before games.

Kaepernick, a NFL free agent of more than seven months, has remained silent after opting out of his contract with the 49ers in March. Last season, Kaepernick decided not to stand for the national anthem during his pregame protests to bring social awareness to police brutality against African Americans. Kaepernick hired his own lawyer, Mark Geragos, instead of filing the grievance with the NFL Players Association. 
Kaepernick’s lawyer, Geragos, released a statement that confirmed he filed a grievance under the CBA on the football players' behalf Monday morning. 
Since Kaepernick began his pregame protests, many players and teams have decided to take a knee during the anthem in support of the message Kaepernick aimed to bring more awareness too. Kaepernick has yet to return to the field. Kaepernick’s lack of opportunity is what convinced him to file the grievance alleging the NFL and its owners “have colluded to deprive Mr. Kaepernick of employment rights in retaliation for Mr. Kaepernick’s leadership and advocacy for equality and social justice and his bringing awareness to peculiar institutions still undermining racial equality in the United States.”
Part of the statement released under the CBA said “such a precedent threatens all patriotic Americans and harkens back to our darkest days as a nation. Protecting all athletes from such collusive conduct is what compelled Mr. Kaepernick to file his grievance.”


WAIT … THERE’S MORE 
Collusion, the allegation filed in the grievance, is extremely hard to prove. Kaepernick would have to prove actual cooperation between teams in the league with tangible proof that he was colluded against.
